Who Gets Fallout?

Bethesda v Interplay
Today, December 12, 2011 the court case between the two minds behind the Fallout franchise fight in a court battle to decide over who officially owns the series. For almost 2 years this legal dispute has finally waited for this day in court.
Both companies estimate that the case will take about 1 - 2.5 days to finish.

So, what does that mean for those of us who don't understand legalese?

Below is taken from The Vault (falloutwiki.com):


1. The burden of proof is on Interplay to prove 3 things.
A. it has a trademark and copyright license
B. it was in full scale development
C. It had secured funding of 30 million.
2. Interplay is not precluded from presenting parole evidence.
3. Interplay is not precluded from presenting evidence showing minimum financing and full scale production.
4. Affirmative defense of mistake will not work for Interplay.
5. Bethesdas witness can be at the trial, but can only testify as to what an MMO is and what it entails...he cannot comment on what Interplay has done.
6. Trial will be at 9:30 A.M. on Dec 12
7. Interplay thinks it will take 2 to 2 1/2 days for the entire trial.

Basically its interplay's case to lose, if they can't proof # 1 above then there case is gone. And if interplay does proof their case then Bethesda's case is gone.

For the sake of the franchise, I hope Bethesda gets it.

Well yeah obviously, but the fall out franchise is kinda dead. I mean, every story has been told and fall out 3's ending just stunk up the rear.

Of course, that isn't to say that Bethesda can't make RPGs. They're great at that. Top of their game in fact. Interplay are whores by comparison.

Regardless, interesting court interpretation.

Ok, the results are a week old but Bethesda and Interplay settled. Interplay got $2 million and Bethesda got the full rights to fallout.
